RULES AND REGULATIONS
The following Rules and Regulations are pursuant to Section 735.27 of the Ohio Revised Code and Section 95.02 of the Code of Municipal Ordinances to improve, operate, and protect parks, parkways, and forests, and provide an agency for their administration.
SECTION 2. DEFINITIONS
(a) Village shall mean the Village of New Lebanon.
SECTION 3. HOURS OF OPERATION
(a) Hours of operation for all Village owned, leased, or otherwise controlled parklands are: one-half hour before sunrise to one-half hour after sunset every
(b) The Director or Police Shift Supervisor in charge at the time shall be authorized to close a park if public safety requires it.
(c) No person shall enter a part of a park during a period of emergency so declared by the Director or Police Shift Supervisor.
SECTION 4. MEMORIAL TREES
(a) The installation and planting of any Memorial Tree, or any Memorial Tree marker, without the permission of the Park Board is prohibited.
(b) Memorial Trees may be planted in designated areas as defined within the Park Master Plan. Trees and markers will be installed by Village employees.
SECTION 5. REMOVAL OR DESTRUCTION OF PROPERTY
(a) No person shall remove from a park or write upon, cut, mutilate, deface or damage any building, equipment, or other property, which is owned, leased, or otherwise controlled by the Village.
(b) No person shall dig, move or carry away any rock, stone, sod, sand, earth, tree, wood, shrub, plant, flowers or seed in a park, or trample upon, injure, destroy, break, cut, chop, or deface any stone, tree, shrub, plant or flower in a park.
(c) No person shall remove any property, or part thereof, which is owned, leased or otherwise controlled by the Village from a park without the written permission of the Director.
(d) The provisions of this section shall not apply to the Village in the development, construction, maintenance, and conservation of park areas or activities performed in the best interest of the Village.
SECTION 6. DEPOSIT OF MATERIALS
(a) No person shall deposit or discard in or adjacent to a park any paper, garbage, fireplace or stove ashes, refuse, or other noxious or waste material, other than in receptacles provided for the disposal of such materials.
(b) No person shall bring into a park any garbage, ashes, refuse, or other noxious or waste material and deposit or discard the same in or adjacent to a park.
(c) The provisions of this section shall not apply to the Village in the development, construction, maintenance, and conservation of park areas or activities performed in the best interest of the Village.
SECTION 7. ANIMALS; PROTECTION OF ANIMALS; HUNTING
(a) No person in a park shall have in his possession an animal of any kind unless the animal is controlled by a leash. All dogs must be on a leash no more than eight feet long and must be under control of a responsible person.
(b) No person being the owner of or having charge or care of a horse shall take it or permit it to be in or upon any Village owned or operated park except by written permission of the Board granted for special occasions.
(c) No person in a park shall abandon any animal.
(d) No person shall hunt, trap or in any other way abuse, molest, injure or chase or destroy any animal or bird within a park. This section shall not apply to any Public Safety or Humane Society Officers acting within the scope of their authority.
(e) Nothing in this section shall be construed to prohibit the use of any certified Handicapped Assistance Dog or other animal.
SECTION 8. FIRES
(a) No person shall start or maintain a fire in a park except in a fireplace or at a site designated.
(b) No person shall start a fire in a park and leave the vicinity without fully extinguishing the fire; scatter coals other than in receptacles provided; burn wood found in a park except as provided by the Village in designated containers.
SECTION 9. CAMPING
No person shall camp in a park except with the written permission of the Board granted for special occasions.
SECTION 10. WEAPONS
No person shall carry, in any manner whatever, any razor, dirk, knife, blackjack, brass-knuckles, explosives, spears, bows and arrows, crossbows, any other implements designed to discharge missiles in the air and/or under the water which are capable of destroying animal life, or any other dangerous weapon or ordinance .
SECTION 11. COMMERCIAL ACTIVITIES
No person shall sell, beg, or offer for sale any article, privilege or service in a park without complying with Chapter 112 of the Code of Municipal Ordinances.
SECTION 12. ERECTING AND ATTACHING SIGNS
No person shall erect any sign in a park or attach any sign to property owned, leased, or otherwise controlled by the Village of New Lebanon, nor shall any person display any placard, notice, advertisement, circular banner, or statement of any kind in a park other than on a vehicle.
SECTION 13. TRAFFIC
(a) No person shall:
(1) Operate a motor vehicle, whether licensed or unlicensed, in a park except on and within the paths and roads provided for such motor vehicles, and no person shall drive a motor vehicle licensed or unlicensed on paths or roads to be used only for the use of specific types of vehicles.
(2) Operate a motor vehicle in a park in excess of the posted speed limit, 10 mph.
(3) Park any vehicle in a park except in places designated by the Village for such purposes.
(4) Park or leave a vehicle in an area of a park at a time when such area is not open to the public.
(5) Operate any form of motorized bicycle, scooter or other type of vehicle, on lands, paved walks or paths, or on any property owned or controlled by the Village, except within those areas specifically designated for such motorized bicycle, scooter or vehicular traffic.
(6) The provisions of this section shall not apply to vehicles used in the maintenance of Village property nor to Village vehicles operated on such property by Village employees, nor to vehicles operated on such property pursuant to a public event sponsored or approved by the Board, nor to emergency or police vehicles.
(b) Any vehicle parked in violation of this section may be removed by a Police Officer to the nearest garage or other place of safety as provided in the Code of Municipal Ordinances.
SECTION 14: WATER AREAS
No person shall enter in or upon any ponds located on Village property. This would include wading, swimming or skating.
SECTION 15. PERSONAL CONDUCT
(a) No person in or adjacent to a park shall conduct himself by work or by act, in a riotous, disorderly, boisterous, threatening or other manner so as to disturb the peace and good order in a park.
(b) No person in or adjacent to a park shall operate or play a radio, TV, musical instrument, or amplifying or sound equipment so as to disturb the peace and good order.
(c) No person in a park shall solicit or procure participants for, engage in, or promote any game, which is played for money or other thing of value, except by permit from the Park Board.
(d) No person in a park shall use insulting, abusive, threatening, profane, or indecent language.
(e) No person in a park shall loiter in the vicinity of a restroom and no person shall enter a restroom facility provided for the exclusive use of the opposite sex.
(f) No person shall make indecent exposure of his or her person in a park.
(g) No person or group of persons shall loiter in or adjacent to any parklands or facilities.
(h) No person in a park shall willfully assault or commit bodily injury upon another or engage in or abet or aid in any fight, quarrel, or other disturbance.
(i) No persons or groups of persons shall assemble in or adjacent to a park for any unlawful purposes or in riotous assemblage or with intent to annoy, harass, or inflict property damage or bodily injury upon another person or persons or inflict damage to a park.
SECTION 16. BEER AND INTOXICATING LIQUORS
(a) No person shall possess or have control over any intoxicating liquor or beer in or upon any Village owned or controlled park, playground, buildings, or other premises.
(b) No person shall sell or offer for sale any intoxicating liquor or alcoholic beverage in or upon any Village owned or controlled park, playground, buildings, or other premises except by written permission of Council.
SECTION 17. NARCOTICS AND CONTROLLED SUBSTANCES
(a) No person in a park shall possess, sell, or offer for sale any type of narcotic drug, opiate, or hallucinogen, or any equipment for administering such drugs, opiates, or hallucinogens.
(b) No person in a park shall smoke, drink, have injected or inject into him/herself, or otherwise use any type of narcotic, drug, opiate, or hallucinogen.
SECTION 18. FIREWORKS AND EXPLOSIVES
(a) Fireworks and explosives are prohibited in all parks and facilities owned and operated by the Village except by written permission for special events.
(b) No person in a park shall have in his possession or ignite any fireworks.
(c) No person in a park shall have in his possession or detonate any explosives.
SECTION 19. EXPLOYEE EXEMPTION
(a) Acts of employees of the Village, to the extent necessary for the performance of their authorized duties, shall be exempt from the provisions of these Rules and Regulations.
(b) The Municipal Manager may from time to time designate a Village Service Department employee or employees to exercise any authority permitted him
SECTION 20. EJECTION FROM PARK
(a) Police Officers may order any person violating any of the provisions of these Rules and Regulations to leave a park and no person shall fail to obey such an order.
(b) Any person repeatedly violating Rules and Regulation may lose the privilege of entering a park for a period of time as designated by the Park Board.
SECTION 21. FINES
Pursuant to Section 95.99 of the Village of New Lebanon Code of Ordinances, any person who violates any provision of the Rules and Regulations adopted in Section 95.02 shall be deemed guilty of a misdemeanor. Upon the first violation of any of the provisions of this chapter, any person may be fined a sum not to exceed $50. Upon the second or subsequent violation of this chapter, any person may be banned by the Municipal Manager from the New Lebanon Parks for a period of up to one year and may be fined a sum, not to exceed $100.
SECTION 22. SCHEDULING AND FEES
All requests for special activities must be submitted in writing at least 30 days in advance of the scheduled event to allow sufficient time for Board approval. User fees and deposits may be required. Request forms are available at the Village Offices, 198 South Clayton Road, New Lebanon, Ohio.
